Tulisan Softskill " Fundamental Rights in Indonesia "



As with other new countries, Indonesia have included some rights in its constitution, either in the Act of 1945 and the constitution is next. Rights contained in the Act of 1945 is not contained in a separate charter, but scattered in some article, especially Article 27-31.

Rights are limited in number and loaded briefly formulated. This is not surprising, given that this manuscript was composed at the end of the Japanese occupation in an atmosphere of urgency. Apart from that among public figures there are differences of opinion on the role of human rights in a democratic state. Instead Dr. Hatta said that although the State formed a family, but still needs to be some set of rights of citizens, not to the State arising out of power. Finally, it is understandable why the rights contained in the incomplete Act of 1945, because the 1945 constitution was made several years before the declaration of human rights received by the united nations.

Receipt of the statement and the agreement by a majority of the union of two nations also shows clearly that the idea of ​​human rights need to be guaranteed, totally supported by all mankind, and not a mere liberal ideas. It is also felt by the Indonesian people themselves, because in drafting the next constitution, namely 1949 and 1950. Turns out that human rights added and expanded.
